1. The Promotion

1.1 By participating in the Ramlegh Springs Wetlands Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not participate in the Promotion.

1.2 This Promotion entitles the eligible Purchaser to a discount on the advertised list price of the block of land of no more than 10%.

1.2 The promoters are Azinna Pty Ltd ACN 005 188 572 and APD Projects Pty Ltd ACN 160 512 452 (Promoter).

1.3 The Promotion closes on 30 April at 11.59pm AEST unless all stock is sold prior.

1.4 The Promoter reserves the right to extend the Promotion period at its sole discretion past 30 April 2020.

2. Eligibility

2.1 To be eligible for the Promotion, you must:

(a) sign a contract of sale (in the form to be provided by the Promoter) for the purchase of a block of land (lot) identified by the Developer as eligible for this Promotion within Stages 9, 10 or 16 Ramlegh Springs Estate in Clyde North prior to 30 April 2020 at 11.59pm AEST (Contract of Sale) with a settlement date on or before 30 June 2020;

(b) have completed the cooling off period under the Contract of Sale prior to 30 April 2020 at 11.59pm AEST, or if the day of sale pursuant to the Contract of Sale is 30 April 2020, have waived your rights to the cooling off period;

(c) if the Contract of Sale is signed on 30 April 2020, the vendor may, in its sole discretion, allow the cooling off period to apply to the sale. If vendor exercises its discretion in this regard, the purchaser agrees the cooling off period cannot be extended past 5.00pm 5 May 2020;

(d) not require approval from the Foreign Investment Review Board for your purchase of the lot and to complete settlement of the Contract of Sale;

(e) are the first purchaser of the lot and have not nominated the lot to a subsequent purchaser, unless the nomination is required to add your spouse or domestic partner as a joint proprietor of the lot;

(f) comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement; and

(g) complete settlement of your purchase on or before 30 June 2020 in accordance with the terms and conditions set out in the Contract of Sale.

2.2 An individual purchasing a lot in accordance with clause 3.1 of these Terms and Conditions by way of a house and land package through a builder is not eligible for the Promotion.

3. Rebate

3.1 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with a rebate in an amount equal to the Promotion (Rebate).

3.2 The Promoter will arrange for the Rebate to be paid to you upon settlement of the Contract of Sale.

3.3 The Rebate is subject to these Terms and Conditions.

3.4 The Promoter is not required to make any alterations to the Rebate.

3.5 Subject to 2.1(d) above, the Rebate is not transferable to another person or entity, including by way of assignment or a nomination of a substitute or additional transferee.


4. General

4.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Rebate or any aspect of the Rebate.

4.2 The Promoter expressly denies and excludes all representations about the Rebate, except as set out in these Terms and Conditions.

4.3 You must not use the Promotion in conjunction with any other promotion or offer in respect of the Ramlegh Springs Estate in Clyde North, Victoria.

4.4 The Promotion shall be governed by the laws of Victoria, Australia.
