1. The Promotion
1.1 By participating in the Ramlegh Springs 12 Days of Christmas Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not participate in the Promotion.
1.2 The promoters are Azinna Pty Ltd ACN 005 188 572 and Ramlegh Springs Developments Pty Ltd ACN 603 644 597 (Promoter).
1.3 The Promotion closes on Tuesday, 12 November 2019 at 11.59pm AEDST.
1.4 The Promoter reserves the right to extend the Promotion period at its sole discretion past 12 November 2019.
2. Conditions of Entry
2.1 To be eligible to enter this Promotion, an individual must be a resident of Victoria, Australia and aged 18 years or over. Employees, directors and other representatives of the Promoter are ineligible.
2.2 Incomplete entries may be deemed to be invalid at the discretion of the Promoter.
2.3 There is a limit of one (1) entry per person, per purchase.
2.4 The Promoter is not responsible or liable for any attempted entries that are not received for any reason, illegible entries, incorrect transcription of entry information, technical failures of any kind in relation to entry to the Promotion, the unavailability of any service in relation to entry to the Promotion, third party interference and technical or human error in relation to the administration of the Promotion. Late entries will not be accepted.
3.1 To be eligible for the Promotion, you must:
(a) sign a contract of sale (in the form to be provided by the Promoter) for an eligible block of land within the Ramlegh Springs Estate in Clyde North during the 12 Days of Christmas expiring on 12 November 2019 at 11.59pm AEDST (Contract of Sale);
(b) have completed the cooling off period under the Contract of Sale prior to 12 November 2019 at 11.59pm AEST, or if the day of sale pursuant to the Contract of Sale is 12 November 2019, have waived your rights to the cooling off period;
(c) if the Contract of Sale is signed on 12 November 2019, the vendor may, in its sole discretion, allow the cooling off period to apply to the sale. If vendor exercises its discretion in this regard, the purchaser agrees the cooling off period cannot be extended past 5.00pm 15 November 2019;
(d) not require approval from the Foreign Investment Review Board for your purchase of the lot and to complete settlement of the Contract of Sale;
(e) are the first purchaser of the lot and have not nominated the lot to a subsequent purchaser, unless the nomination is required to add your spouse or domestic partner as a joint proprietor of the lot;
(f) comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement; and
(g) complete settlement in accordance with the terms and conditions set out in the Contract of Sale by no later than 31 December 2019.
3.2 An individual purchasing a lot in accordance with clause 1 of these Terms and Conditions by way of a house and land package through a builder, is eligible for the Promotion. For the avoidance of doubt, the Promotion will not apply to an individual purchasing a town house.
4. Payment of 12 Days of Christmas Offer
4.1 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with a rebate in the amount of $20,000.00, such rebate to be paid either at settlement or by way of a VISA gift card (Promotion Payment).
4.2 The Promoter will arrange for the Promotion Payment to be paid to you either at settlement or, in the case of a VISA gift card, within 20 Business Days of settlement occurring in accordance with the Contract of Sale.
4.3 The Promotion Payment is subject to these Terms and Conditions.
4.4 The Promoter is not required to make any alterations to the Promotion Payment.
4.5 Subject to 3.1(d) above, the Promotion Payment is not transferable to another person or entity, including by way of assignment or a nomination of a substitute or additional transferee.
5.1 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Promotion Payment or any aspect of the Promotion Payment.
5.2 The Promoter expressly denies and excludes all representations about the Promotion Payment, except as set out in these Terms and Conditions.
5.3 You must not use the Promotion in conjunction with any other promotion or offer in respect of the Ramlegh Springs Estate in Clyde North, Victoria.
5.4 The Promotion shall be governed by the laws of Victoria, Australia.
